Stay Tuned

My home is 5 years old. Not old enough to be falling apart. And yet, several (more like numerous) home in my community are having the same problem. The concrete was poured incorrectly and, due to shifting conditions, has started to crack and separate from the footings and frame, etc. This has resulted in some gaps at the base of the floorboards. Some areas are worse than others. Some homes have more extensive damage than mine and some have none at all.
The complaints started going to our builder, but the builder (who I shall keep anonymous at this point) said that since those homeowners weren't original owners, the warranty wasn't valid and they wouldn't fix it. Then our HOA started checking and investigating, finding out it was a more serious problem. So it was decided to contact a law firm who specializes in HOA business. They sent a letter of demand to our builder.
The builder responded three days ago with a letter saying that if we had any complaints or issues, to please let them know and they would take care of it. haha- awww- gotta love double talk. Anyway, so here are my pictures. This is about half of them. You can see the gaps. And I can always tell when another one shows up because I get a little ant colony inside. :)
Can you see the crack in the cement under the linoleum? yes... its headed towards my kitchen counters. If it reaches there before the builder can fix it, they'll be replacing a lot more than just cement!
I sent in my letter with my pictures this afternoon. We'll see how quickly the builder responds. Our HOA has not filed a lawsuit, but we've given them the opportunity to fix it. If they don't, we'll need to file before the statute of limitations is up.
Worst case scenario: They do nothing and the HOA goes to court.
Best case scenario: I move all my first floor belongings into my garage while they fix my floor, replace everything and then put it all back together!

I'm glad they finally agreed to fix things... it is too bad that it takes the threat of court for a builder to suddenly find his integrity... I hope it all gets worked out!
